Terms of Service

Welcome to Peak Hybrid. These Terms of Service ("Terms") govern your use of the Peak Hybrid mobile application and related services (the "Service"). Please read them carefully.


1. Acceptance of these Terms

By downloading, installing, or using Peak Hybrid, you agree to these Terms. If you do not agree, please do not use the Service.

2. Who we are

Peak Hybrid is operated by Suncraft Collective, LLC ("Peak Hybrid," "we," "us," or "our"), a California limited liability company.

Our Privacy Policy is available at peakhybrid.app/privacy and is incorporated by reference into these Terms.

3. Eligibility

You must be at least 13 years old to use Peak Hybrid (or the minimum age required to consent to online services in your jurisdiction, whichever is higher). If you are under the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Your account

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Keeping the email address on your account current so we can reach you.

You can delete your account at any time in the app via Profile → Delete Account. Deletion removes your data in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that we believe, in good faith, are engaged in abuse, fraud, harassment, or violation of these Terms.

5. Subscriptions and billing

Peak Hybrid offers a free tier with generous limits and an optional Pro subscription that unlocks additional features.

Pricing

  • Pro Monthly: $9.99 / month
  • Pro Annual: $69.99 / year (approximately 42% off the monthly rate)

How billing works

  • All subscriptions are purchased and managed through Apple In-App Purchase. Payment is charged to your Apple ID at confirmation of purchase.
  • Subscriptions auto-renew at the end of each period unless you cancel at least 24 hours before the current period ends.
  • Renewals are billed to your Apple ID at the then-current price for your plan.

Managing or cancelling

You can manage or cancel your subscription at any time in your Apple ID account settings:

Settings app → [your name] → Subscriptions → Peak Hybrid

Cancelling takes effect at the end of the current billing period. You keep Pro access until then.

Refunds

Refunds for App Store purchases are handled directly by Apple under Apple's refund policy. We do not process refunds for subscriptions purchased through the App Store.

Price changes

We may change Pro pricing in the future. If we do, we will give reasonable advance notice. Existing subscribers will not see a price change during their current paid period.

6. Acceptable use

When using Peak Hybrid, you agree not to:

  • Scrape, harvest, or abuse our API or any data the app exposes.
  • Reverse-engineer, decompile, or attempt to extract source code from the app.
  • Use the Service to harm yourself or others, or to misrepresent medical or physical conditions.
  • Treat the Service as a medical, clinical, or diagnostic tool. Peak Hybrid provides fitness analytics and training context, not medical advice.
  • Interfere with the Service's operation, security, or other users.
  • Use the Service to violate any applicable law or regulation.

7. Content and intellectual property

Your data is yours. Workout entries, body metrics, notes, and other content you create or import remain yours. You grant Peak Hybrid a worldwide, non-exclusive, royalty-free license to store, process, transmit, and display that content solely for the purpose of operating and improving the Service for you. This license ends when you delete the content or close your account, except where we are required to retain limited records (see Privacy Policy).

Our software and brand are ours. The Peak Hybrid app, source code, design, brand, name, and logo are owned by Suncraft Collective, LLC and protected by intellectual property laws. These Terms do not grant you a license to copy, modify, distribute, sell, or create derivative works of the Service.

Strava trademarks are the property of Strava, Inc. Peak Hybrid is an independent client of the Strava API and is not affiliated with, endorsed by, or sponsored by Strava.

8. Third-party services

Peak Hybrid relies on a small number of third-party services. Connecting them is your choice, and their terms govern their parts of the experience:

  • Apple: App Store distribution and In-App Purchase billing.
  • Strava: optional OAuth integration for importing activities and (where enabled) syncing activities back to Strava. Governed by Strava's Terms of Service and API Agreement.
  • Supabase: backend hosting for authentication and data storage.
  • RevenueCat: subscription management infrastructure (does not directly process your payment; Apple does).

We are not responsible for the availability, accuracy, or terms of third-party services.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

Not medical advice. Peak Hybrid is a fitness app. The metrics, training context, and suggestions it provides are not medical advice and are not a substitute for consultation with a qualified healthcare or training professional. Always consult a professional before beginning, modifying, or intensifying any training program, especially if you have a medical condition or are pregnant.

Ruck, weighted, and high-load activities. Rucking and other weighted activities carry meaningful injury risk if performed without appropriate preparation, load progression, or footwear. You are responsible for your own training choices and for assessing whether any activity is safe for you.

You use Peak Hybrid at your own risk.

10. Limitation of liability

To the maximum extent permitted by law:

  • Peak Hybrid, Suncraft Collective, LLC, and our officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service.
  • Our aggregate liability for any claim arising from or related to these Terms or the Service will not exceed the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or USD $100, whichever is greater.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the smallest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Suncraft Collective, LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the Service.
  • Content you submit through the Service.
  • Your violation of these Terms or applicable law.
  • Your violation of any third party's rights.

12. Governing law, arbitration, and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

Individual arbitration. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court. Arbitration will be administered under the rules of a recognized arbitration provider (such as JAMS or AAA) and will take place in San Luis Obispo County, California.

No class actions. You and Peak Hybrid agree to bring disputes only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Small claims exception. Either party may bring an individual claim in small claims court if eligible.

Injunctive relief. Either party may seek injunctive or equitable relief in a court of competent jurisdiction in California to protect intellectual property rights.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in-app, by email, or both, before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, please stop using the Service and delete your account.
